A will written for your state, your family and your wishes.

A will says who gets your property, who looks after your children and who handles your estate after you die. If you do not have one, your state decides, and its rules may not match what you want. A will writing service gives you a document built around your life, not a blank form you fill in alone.

Our international estate planning lawyers are experienced with US state law. We ask about your family, your property and your wishes, then draft a last will and testament that follows your state’s rules on signing and witnesses. This page is for wills in the United States. For the same service in other countries, see our global will drafting service. To learn what makes a will valid, read our guide to creating a valid will.

Will writing services we offer in the USA

Choose what fits, or tell us your situation and we will advise.

    Simple last will and testament

For one person, or a couple with matching wills. It covers who inherits, who is your executor and who looks after your minor children.

See the last will and testament template for the usual layout.

    Guardians for minor children

Name who raises your children if both parents die, with a back-up choice. You can also decide who manages the money you leave them, and until what age.

    Wills with trusts

Leave assets in a trust for children, a spouse or a family member who needs help managing money. We also write pour-over wills that work with a living trust.

Not sure if you need one? Read will vs trust and how to choose the right trust.

    Specific gifts and personal items

Leave a house, a car, savings, jewellery or items with sentimental value to named people. We use clear wording so the gift cannot be read two ways.

    Blended families and second marriages

Provide for a spouse and for children from an earlier marriage in the same will, with wording that makes your intention clear and lowers the chance of a family dispute.

    Business owners and self-employed people

Cover your LLC or company interest in your will so the business has a plan if you die.

    Updating or replacing a will

A marriage, divorce, birth, move to a new state or big change in assets can make an old will wrong. We prepare a codicil or a fresh will and tell you which is safer.

Living will and power of attorney

Companion documents that cover medical decisions and money matters while you are alive. Ask us to prepare them with your will.

    US wills for different situations

The people and families we write for.

    Parents of young children

The most urgent point is a guardian. If you do not name one, a court chooses. We also set up how and when your children receive money.

    Homeowners and families

We cover the house, bank accounts and personal items. We also remind you that retirement accounts and life insurance usually go to the person named on the beneficiary form, not under your will, so the two must match.

    Couples and blended families

Matching wills for spouses, or separate plans for a second marriage, so a partner is looked after and children from before are not left out.

    Business owners

A will that deals with your ownership share, names who steps in, and works with your LLC or partnership papers.

International families living in the US

If you hold US assets and property in your home country, you may need more than one will. We coordinate the US will with the will for property abroad. For India, see will writing services in India.

Non-US residents with US property or accounts

Owning US property or accounts can bring US estate tax at a much lower threshold than for US citizens, and a US court process after death. We advise how to set up your will with that in mind.

What changes from state to state

Wills are a state matter in the US. These are the points we check for your state.

    Signing and witnesses

Most states want the will signed in front of two witnesses. Who can witness, and whether a notary is needed, differs by state.

    Self-proving affidavit

A notarised statement signed with the will. In many states it lets the court accept the will without calling the witnesses, which can speed up probate.

    Community property states

In states such as California, Texas and Arizona, spouses may co-own property by law. That affects what each of you can leave in a will.

    Protection for a surviving spouse

Many states stop a spouse being fully cut out of a will. Louisiana follows civil law and has its own forms and rules for children.

    Electronic and handwritten wills

Some states accept electronic or remote signing, and some accept handwritten wills. Many do not. We tell you what applies where you live.

    Estate and inheritance tax

The federal estate tax only reaches larger estates: the exemption is $15 million per person in 2026. Some states have their own estate or inheritance tax at much lower levels.

Why clients choose us for a US will

    • Written for your state. Your will follows the signing and witness rules where you live, and we tell you exactly how to sign it.
    • Lawyer-led. Our estate management lawyer reviews the work, and the document is written for your family, not copied from a form.
    • Plain language. We explain each choice in short sentences, so you know what you are signing.
    • Price known upfront. You see the scope and fee before any work starts.
    • Fully online. No office visit. Talk to us by video, phone or WhatsApp at a time that suits your time zone.
    • Private. What you share about your family and finances stays confidential.

    4. Sign it correctly

We send step-by-step signing instructions for your state, covering witnesses, notary and the self-proving affidavit where it applies.

    5. Store it and keep it current

Keep the original safe, tell your executor where it is, and come back to us when your life changes.

    Common questions

Do I need a lawyer to write a will in the USA?
No law says you must. But a will that is badly worded or signed the wrong way can fail or lead to disputes. A lawyer-drafted will is written for your state and your family, and you get clear signing steps so it holds up.
Is an online will valid in the US?
A will written online is valid if it meets your state’s rules on age, mental capacity, writing, signing and witnesses. How it was prepared matters less than how it is signed. Some states also allow electronic signing, with strict rules. We tell you which steps apply to you.
What happens if I die without a will in the USA?
Your state’s intestacy law decides who inherits, usually your spouse and children first, then other relatives. A court appoints someone to run your estate and, if you have minor children, decides who looks after them. The result may not match what you wanted.
How much does a will cost?
We quote a fixed fee after we understand your situation. A simple will costs less than a will with trusts for children or a blended family. You see the fee in writing before we start.
Should I have a will or a trust?
Many families need a will. A trust can help manage money for children, keep matters private or avoid some of the probate process, and many people use both. Read will vs trust and how to choose the right trust, or ask us.
I live outside the US but own US property. Can you help?
Yes. We write a will that deals with your US assets and explain how it fits with a will in your home country. US estate tax and a US court process can apply, so a joined-up plan is safer than two separate documents.
Can you handle probate after death?
Our service is writing and updating wills. Probate runs through a state court and often needs a lawyer licensed in that state. We explain the process to your executor so they know what to expect.
