    What exactly is a trademark, and what can be registered.

    A trademark is any sign capable of distinguishing your goods or services from those of another business. It does not have to be a logo. Under Argentine law, INPI recognises a wide range of signs as registrable, as long as the mark is distinctive and not merely descriptive of the product itself.

    What makes a mark registrable

    The mark must be capable of distinguishing your goods or services, must not be identical or confusingly similar to an existing registered mark in the same class, and must not be purely descriptive, generic, or contrary to public order. A name like “Best Coffee” for a coffee brand is weak and hard to register; a coined or distinctive name is far stronger.

    Argentina is a first-to-file jurisdiction for practical purposes: registering early protects you even against someone who started using a similar mark informally but never filed. Waiting to register while you build a brand is a common and costly mistake, since someone else can file first.

    Trademark classes in Argentina, and why they decide your protection.

    Argentina uses the international Nice Classification, the same system used by INPI and most of the world’s trademark offices, which divides all goods and services into 45 classes: 34 for goods and 11 for services. Your registration only protects you in the classes you actually file in. A mark registered in Class 25 (clothing) gives you no rights over someone using a similar name in Class 41 (education services), unless your mark is well-known enough to claim broader protection.

    Choosing the right classes is one of the most consequential decisions in the filing. File too narrowly and a competitor can use a similar mark in an adjacent category you forgot to cover. File too broadly and you pay for protection you do not need and may invite an unnecessary opposition from an unrelated business.
