The single most important thing to understand about trademarks is that they are territorial: a registration in India protects you in India, not in the United States, the United Kingdom, the UAE, or anywhere else. If you sell, ship, or build a brand across borders, you need protection in each market that matters.

    There are two broad routes to global protection. You can file nationally, applying directly in each country through its trademark office, which gives you the most control and is often best for a small number of specific markets. Or you can use the Madrid Protocol, an international system administered by WIPO that lets you file one application, in one language, to seek protection across more than 120 member countries, based on a home application or registration. The right route depends on how many countries you need, where they are, and your budget.

    Across either route, the fundamentals are the same: a clearance search to check the mark is available, correct classification under the Nice Classification of goods and services, a properly drafted application, and a response to any objection or opposition the examiner or third parties raise.     National filing

    You apply directly in each country’s trademark office. This gives you maximum control, lets you tailor the application to local practice, and can be the most cost-effective when you only need a few specific markets. It is also the route for countries that are not part of the Madrid system.

    The Madrid Protocol

    One application through WIPO, based on your home filing, can seek protection in more than 120 member countries. It is efficient when you need several markets at once, simplifies renewals into a single international registration, and is usually more economical at scale. The trade-off is that for the first five years the international registration depends on your home application, if that home mark is refused or cancelled, the international one can fall with it, known as a central attack.

    Is one trademark valid worldwide?

    What is a clearance search and do I need one?
    A clearance search checks whether a similar mark already exists in your target market before you file. It is strongly recommended, because filing a mark that conflicts with an existing one wastes the official fees and can invite opposition. We run it as a first step.
    What are trademark classes?
    Goods and services are grouped into classes under the Nice Classification. You register your mark in the classes that match what you sell. The classes you choose define the scope of your protection, so getting them right matters.
    Can you guarantee my trademark will be registered?
